The "Right Thinking
Indians Association" has sought information & document under the RTI
Act from the Directorate of Education, Raipur, Chhattisgarh about number of
poor children who got their admission under the provision of Right to Education
Act. The information has been denied on the ground that BPL card holder is not
entitled to get the information & document without payment of payment of
Application fees. Our contention is that BPL card holder has a right to get the
document & information and is not required to pay the Application of Rs
10/- . This is as per section 7 (5) of the RTI Act, 2005. The State Govt have
been authorized to prescribe their own fees but they are not entitled
to charge Application fee of Rs 10/- when there is clear cut provision of
exemption from Application fee under Section 7(5) of the RTI Act. No State Govt can
make any provision by overriding the main Act. With
this contention we have filed the 1st Appeal which is uploaded for
public viewing.
