We
have sought information & document about getting service in BSNL Raipur, a
Govt of India Undertaking on the basis of fake certificate & mark sheet.
The CPIO of BSNL has denied information on the ground that the information
related to IIIrd party. The question arises whether copy of Certificate of a
Govt employees kept in the Govt office should be supplied under the RTI Act,
2005 or not. The RTI Act contains an exclusion list but such negative provision
restricts supply of Trade secret, formula and such things which are not
necessary for public interest. Here, one gets service on the basis of fake certificate and he gets protection by
Public Information Officer. The question is if the certificate of the person is
genuine, then there is nothing to worry. The fact that BSNL officer is not
supplying the copy of certificates indicates that the doubt raised on the
certificate is quite genuine. RTI Act has been framed to contain corruption and
bring transparency. Obviously, denial of information & document is a
violation of RTI Act. The Right Thinking Indians Association has filed 1st
Appeal against the decision of CPIO. The denial letter of the CPIO is uploaded
for public viewing.
