Fight for minimum wages in Central Excise, Bhilai & Census department, Raipur

The “Right Thinking Indians Association, Raipur, Chhattisgarh has made a Complaint about less payment by Contractors to the Daily wages workers by the Contractors of Central Excise Division-I & II and Census Department, Raipur outsourced by the Govt Departments. Shri D.K Singh Dy Commissioner of Labour Office, Raipur has taken cognizance of the complaint made by “Right Thinking Indians Association, Raipur, Chhattisgarh” and desired that Association should meet the Labour Enforcement Officer.

Accordingly, Shri Arun Pati, President of the State Association and Shri Mukesh Gindone, Secretary of the Raipur District met Shri Nayak, the Labour Commissioner and discussed in detail about the plight of the daily wages workers and payment of less wages prescribed by the District Collector. Shri Nayak assured the Association that he will conduct a speedy investigation of the matter in both the cases.

Our Organisation is not like INTUC, AITUC etc. What we talk, we talk from our heart and implement the same. It is our strong will & determination that we give the laborers the much needed and long awaited justice which they deserve. Nobody is giving them any mercy. It is their right. Only we are trying to do the needful.

The patron of the Organization, Shri Sanjay Thul was communicated about the developments. The result is awaited.

Daru wale se par pa nahi sakte

It is a fashion to take drinks. After wads, it become a habit. Even the Gods also take drinks. Dat they call as “Somrash” a word coined by the “Devatas” 2 increase the prestige of drinks. Lord Indra is the famous “Bewada” of Heaven. The record shows that he gives serious headache at regular intervals to the Supreme Lord “Vishnu” in his short span of life 10,000 years. A human being lives 4r maximum 100 years, Dat period 4r Devatas is 10,000 years but I am not concerned wd Devatas rather my fellow beings detailed as under:-

After, dtd 1.5.2011, every Bar & Restaurant fitted wd an Air Conditioner is required to obtain a Service Tax Registration for the activity of providing liqueur in such Bar & Restaurants and also required to pay Service Tax after crossing Rs 10 lakhs sale & service.

So, both State Govt Department & Central Govt Department comes into picture. State Excise Department issues Bar permit/licensee. Dat we have sought under the RTI Act, 2005. The Public Information Officer of State Excise Durg has replied the RTI Application in a positive manner. The Reply says that among other parties there are 68 parties of F4 License. We r giving an RTI Application to Central Excise Department as to many r Registered with Central Excise Department and how many r paying Service Tax and that too how much?

If Govt fails 2 collect the Tax, it should be abolished. We cannot allow one simple party vl pay and the other Dabang party vl b allowed to escape. Hence, a Dabang Association named as “Right Thinking Indians Association, Chhattisgarh” has been formed to protect the simple & innocent and fight against the Dabangs who r enemies of the Country as well as Society.

The RTI Response letter dtd 2^nd May, 2013 is uploaded 4r public viewing. Again we appreciate the positive attitude of the PIO in providing the correct reply which vl go a long way in protecting Govt Revenue.

The Central Govt collects Service Tax, Education Cess & Secondary Higher Education Cess (SHEC). It keeps Service tax amount wd itself but returns the Education Cess & SHEC to the respective States. So, the conclusion, every Ed. Cess & SHEC evaded is a direct loss 2 the Educated Department of Chhattisgarh, my dear young boys & girls who wants 2 read, write and march ahead. I cannot afford 2 remain silent. I am deeply hurt by the present scenario.

The RTI information received from CPIO, Central Excise, Bhilai-II vl be shortly uploaded. It says that only Rs 3.73 lakhs is the amount against M/s Rockfort Bar & Restaurant, Nehru Nagar, Bhilai. It is the amount against its supply to its sister concern M/s Grand Dhillon, Nehru Nagar, Bhilai. Regarding rest supplies and daily supply of drinks, the unscrupulous tax payer is not willing to pay Tax and the so called busy officers are too busy in beating the bush and doing trifle jobs. Dats the tragedy of or country.

Fighting for poor

The “Right Thinking Indians Association, Chhattisgarh” has complained about short payment of wages. The Contractor is making payment of Rs 3700/- to Rs 4000/- per head and taking signature in the receipt as Rs 5,800/- from the Daily wages workers employed in Central Excise Division-I & II, Bhilai, Chhattisgarh. The minimum wages fixed is RS 6,300/- and the Collector’s Circular is available.

It is more or less same in every Govt Department. The minimum wages fixed by the District Collectors of Raipur & Durg are not being paid to such Daily wages workers. There is no Trade Union/labour Association to hear and take steps for redressal of the plights of the poor laborers.  The so called philanthropists and political leaders have their own arguments / pleas and no time to look into the social problems.

We have heard that the complaint was disposed off by the Labour Commissioner in favour of the labour Contractor. In the mean time, a complaint was also sent to “Human Rights Commission, Chhattisgarh” who in turn has sent the same to the Labour Commissioner office of Raipur, Chhattisgarh. Now the Labour Commissioner’s Office has taken cognizance of the Complaint of “Right Thinking Indians Association, Chhattisgarh”. The Asstt Labour Commissioner Shri D.K Singh has directed the Labour Enforcement Officer to conduct Enquiry of the matter. Let us see the result.

The Association will never leave the cause of poor persons who are struggling hard to arrange their 2 time meal every day. This is most noble cause in life i.e to fight for the proletariats and give them the much needed and much awaited justice.

Wrongful denial of Right to Information by Mining Department of Chhattisgarh.

We have called for information about AGCG Report from the several Government Department of Chhattisgarh and also from Central Govt Departments. We have received the same except mining Department. The mining Department has denied on the ground that the original AGCG Report is lying with Accountant General Office of Chhattisgarh. It is beyond comprehension as to why the Original Report will not be kept with the concerned mining Department. Besides this another ground on which RTI Application denied information by Public Information officer  (in short PIO) of Mining Department of Chhattisgarh on the basis of a letter dtd 1.11.2011 addressed to Editor NDTV. The letter dtd 1.11.11 is also uploaded for public viewing. The reading of the said letter says about Audit memos which are preliminary reports & on the basis of those preliminary Audit Memos, Audit Report is prepared. Thus these preliminary Audit Memos not final ones but here we are not seeking any Audit preliminary memos, not seeking any correspondence between  Auditor & Auditee rather the Final Audit Reports of 2010-11 & 2011-12. The point arises whether  the Audit Report of a Govt Department namely Mining Department of Chhattisgarh is the personal property of PIO and cannot be supplied under the RTI Act, 2005. The media of Chhattisgarh is busy in publishing the matters related to Ministers & other trifle matters and therefore the “Right Thinking Indians Association, Chhattisgarh” has undertaken the self imposed task of unearthing the Truth & irregularities pointed out by the statutory Audit.

The Right Thinking Indians Association, Chhattisgrah has conducted meeting in Regal Hotel, Bilasspur with dozens of  persons of Bilaspur City and a regular unit of the Association has been formed. Shri Biman Roy, Secretary of the Association will keep touch with veteran RTI Activist Madam Satyavama Roy of Bilaspur District and other progressive  thinkers & social activists of the City s well as of the Bilaspur District. It was decided in the meeting that the Association will raise social problems  of the District & the State regularly. The busy schedule of 15th June, 2013 did not allow us to take a single snap of the meeting. I really felt the absence  our In charge of publicity department cum spokesman of the Association Shri S.K Dani. Had he been there, he would have taken at least 3/4 snaps. Anyway, taking a photograph is not much importance. Work lies ahead and I mentally prepare myself for the Sunday's schedule. 

defrauding Govt by making false Medical Bills.

Indore is called as Mini Mumbai. It is a good City and the people of the City r also good. Among other qualities, the people of the City possess a power of earning money by hook or crook.

Shri M.H Ingle, the Retd. Asstt. Commissioner is one such person. It has been learnt that he by fraudulent means has caused loss of Revenue to the tune of Rs 25,000/- X 24 months by claiming false Medical Bills. He sanctioned the Bills as the head of the Division and after this sanction and prior to this sanction, there was no system in the Department to check the authenticity of Medicines. It has been learnt that most of the medicines claimed in the Bill are in fact Tonics which are not fit to b passed as genuine claims.  

The Association after receipt of copy of Bills will get it examined by prominent medicine experts and after this examination will send a complaint to DG, Vigilance. We cannot simply sit as silent spectators of this scenario of making fraud wd Govt of India.

The name of the officer of O.S.D (officer on special Duty) to the C,M of Chhattisgarh is Shri Vikram Sisodiya. He was Inspector of Central Excise when he was called on deputation by the State Govt Of Chhattisgarh. Now he has been given the post of Secretary. An Inspector was promoted to the post of Superintendent, Central Excise, Indore. 

The “Right Thinking Indians Association, Chhattisgrah” wants to know the law/procedure/ notification/ circular under which the man working as Superintendent of Central Excise (a Class II gazetted post) can be promoted to the post of Secretary, a senior level of Officer. where others fear, the Association seeks answer straight way. We r dedicated ourselves 4r public welfare.

   I.            The “Right Thinking Indians Association, Chhattisgarh”  has observed that one Restaurant named as M/s Jalaram Sweets & snacks, Bhilai-3 , Chhattisgarh is doing excellent business but does its business without issuing cash memos / Receipts of money in their Counter. Obviously, it is an indication that the same party is not paying Income Tax correctly. Therefore,  an  RTI Application has been filed with Chief Income Tax Commissioner, Raipur for supply of Income Tax Return by the said Party. We want all the Income Tax Returns filed by the Party from the starting of their business in Bhilai-3, Bhilai of District-Durg.

he Right Thinking Indians Association, Chhattisgarh has sought information regarding implementation of RTE Act. Under this Act, the Private Schools are bound to give admission to poor students without taking donation.

The DEO, Mahasamund has intimated that 130 schools has been given admission. This is a part information. We have sought informationabout number of children admitted in the Private schools. 1st Appeal is being made for getting full reply as sought in the RTI Application.

Regarding RTI response of District Kabirdham, it is seen that a complete chart containing all the details sought has been provided. Both the replies positive as well as negative  r uploaded for public viewing.

The Association is thankful & grateful to our energetic  leading RTI Activist.

If the young man can do so many work, we hope that wd a scooter he vl do miracle. The Country is waiting 4r such miracles.
