The Kerala High Court has already held it as unconstitutional and given their verdict in favour of the party.

My friends of Raipur Central Excise are asking who has filed  & own the case in Kerala High Court. The name of the Party is Kerala Classified Hotels and Resorts Association vs Union of India. The matter has been published in 2013-TIOL-533-HC-KERALA-ST. A scanned copy of the gist of the publication is uploaded here & shared wd FB.

4th Arrest case of Service Tax in the Country

         


As per Section 89 of the Finance Act, 1994, if a Service provider collects Rs 50 lakhs or more and keeps in his own pocket without depositing with Central Govt for more than six months, such act is illegal and is punishable. The person can be convicted & imprisoned from 6 months to 1 year depending upon the gravity of the offence. The defaulter can be arrested under Section 90 & 91 of the Finance Act, 1994. This new provision of arrest has been introduced w.e.f dtd 10.5.2013.

The first arrest in Kolkata involved an amount of Rs 79 lakh, His name is Sri Sudip Das, Managing Director of a Courier Comapnay. The second one in Mumbai involved Rs 1.96 crore. The Delhi case is much bigger. This is the third case in the country on the charge of service tax collected but not deposited with the Government It was Rs 6 crore. Service Tax was collected by the company from its clients as service tax to be paid to the exchequer, but was not deposited. The Department asked  Jasjit Singh Sawhney, Managing Director of IT Firm to deposit the amount. Sawhney gave an undertaking, but failed to comply and was arrested.


Now, the 4th case of the Country is in Chhattisgarh. The evader is M/s Vasva Engineering Construction, Bhilai, Chhattisgarh. The owner of the concern, Shri Sandeep Nair who had collected Rs 2.17 Crore from his clients but had not deposited the same with the Govt Exchequer in spite repeated persuasion from the Departmental officer of Central Excise & Service Tax Commissionerate, Raipur Chhattisgarh. Shri Nair failed to deposit the amount as assured by him and ultimately arrested on 15th Oct, 2013. The outcome of the case & arrest is awaited.

Intellectual ka Tamasha b4r Election

Meeting on 8th in Capital City of Raipur on Election matter
I was invited to a meeting and was given an attraction to speak my feelings and ideas on the Occasion. The meeting was meant to check Corruption in coming Assembly Election of Chhattisgarh. The Organizer was a journalist. So, I felt proud to feel as an important person. I thought that I was taken as a serious man and also intellectual of the Capital City of Raipur.

In the famous “Tija” festival, I was also glad to be accompanied with my wife. We both listened the useless talks of speakers with rapt attention for complete 2 hours but my turn never came. The only man on the Dias who spoke from his heart and with emotion was a business man wearing a half shirt. He requested another speaker cum an office bearer of Chhattisgarh Chambers of Commerce to give a holiday on the Election so that 100% voting can be done. The Chamber of Commerce president was a Sindhi Businessman. The daring man argued that Election is being done in a competitive manner. So, they are also forced to spend more. Similarly, Swaviman Manch leader plainly said that anybody who has money can spend. The Organizer did not comment on these difference of opinion stated by Spejakers because his main business was to give smiles & smiles. It seemed that it was a sponsored program either of Election Commission or a joint venture with BJP but on any occasion, the Organizer has been paid well and he could not resist the waves of smiles coming from his heart.

I congratulate the learned intellectual & journalist Shri Nayar of the City.  He spoke fluently on the misdeeds of the Ruling Party but forgot to speak a single sentence of the Topic. This happens when a journalist gets a bigger amount than his expectation. He said that Media is helpless (jhunjhuna bajane wala). He was speaking about himself. He should remember the heroic efforts of Great Tilakji and imagine the efforts undertaken as editor of “Kesri” during the tyranny of British Rulers.

Yet, I felt that something is going on. If Veteran Social Activist “Annaji” can visit America with Vidya Balan to check Corruption in India, then anything happen.

So, why scold the poor voters who vote in exchange of cheap drinks and small amounts of money.


Once, our loving Bapuji has forced elected President “Subhash Chandra Bose” to quit for the defeated candidate “Pattavi Sitaramaya” only on the ground that he was a favorite of Bapuji, obviously our Mahan loving Country will go in the same way-----à

IInd Project Report of “Right Thinking Association”

Raipur, Chhattisgarh.

The 1st Project Report of the Association was meant for arousing a political consciousness among Citizen of India, encourage them to participate in State Assembly Election of Chhattisgarh in large numbers and to create an atmosphere in which good and capable leaders get elected to the State Assembly. In short, it was an attempt for achievement of Democratic ideals & good governance.

Now, we focus on a practical problem of Raipur & Durg, Bhilai, the twin City of the State. The problem is the bad condition of the public Roads in both the Cities. It is more or less of all the Cities of our Country in Rainy Season. In many of the twin mentioned above, a lot of big & deep holes have been created due to the heavy Rains in the current Rainy Season. It is a fact that, Govt Departments namely PWD & City Municipality repairs the Road in a delayed manner and that too with a poor quality.

So, without waiting for the delayed & poor repairing work of the Public Roads, Our Association wants to undertake the much needed Public Welfare work i.e. “Repairing work of the Road”. If we are not in position to get any Fund immediately for Construction at a big level but small steps of patching work of the Road after getting help from generous Builders and with Public support, this job can be done. There is no doubt. There are around 500 Builders, big & small in Raipur. So, out of 500, we can get at least 5 Builders who can spare 1 bag of cement each. Let us fill a single pot hole, see it after patching work and let people see it and give their own comment.

What is lacking is not lack of donors, rather lacking of numbers of Receivers of Donations, genuine Receivers. At present, we have not yet 5 genuine volunteers who speak from heart and work with a heart which throbs for Public welfare.

There is a misconception that volunteers who work for Public must be poor and the condition of a Public welfare worker is that he must be a confirmed “Nalayak”. He must neglect his family, wear poor dresses & own damaged vehicles etc & etc. This misconception is a gift of Gandhian Philosophy for which our Country is suffering for last several decades. I say with emphasis “No” to this Concept.

In Bastar, 300 km away from the Capital City of the State, Naxalites are engaged in digging & destroying of the Public Road constructed by the Govt and we are thinking for doing patching work of the Road in a voluntary manner. No doubt, it is a novel idea but with support of views and implementation of the good and constructive thoughts, ideas & ideal are transformed into real work.

This is our IInd project. Not a dream. Beginning of transformation of a Dream into real projects.

1st Appeal in Income Tax Department under the RTI Act, 2005.

Income Tax Department of Raipur, Chhattisgarh conducted a raid and detected a disproportionate asset case in IAS officer Shri Babulal Agarwal’s matter. The “Right Thinking Indians Association, Raipur, Chhattisgarh” sought information & document about the stage of development in the said case. Being denied, the Association has filed Appeal in IT Department.

Chhattisgarh Govt is snatching the power of BPL Card Holders

The Govt has introduced several welfare schemes for poor people. In these days, a word has has been coined called as “Below Poverty Line” in short “BPL”. A Card is issued to such persons. The question arises who is BPL Card holder?
The answer has been provided in RTI response letter of Municipality of Rajnandgaon, Chhattisgarh. BPL card has been issued to a family whose family members earn Rs 508.26 per month. The relevant pages RTI letter is uploaded for public viewing.

The paradox is that one can get ration on the basis of this card but cannot get RTI information & document free of cost which has been specifically provided under the RTI fee Rules, 2005.
